You acknowledge and agree that:

  • The AI system may produce inaccurate, incomplete, or misleading results
  • Candidate information may contain errors or be outdated
  • Matching scores are algorithmic estimates and should not be the sole basis for hiring decisions
  • You are solely responsible for verifying all candidate information independently
  • You will comply with all applicable employment laws and regulations
  • You will not use the Service for any unlawful or discriminatory purposes

4. Third-Party Data and Services

Our Service relies on third-party data providers and APIs. We do not control, verify, or guarantee the accuracy of third-party data. You understand that third-party services may be unavailable, delayed, or contain errors, and you agree to hold us harmless for any issues arising from third-party service failures.

5. AI and Algorithmic Limitations

IMPORTANT DISCLAIMER: Our AI-powered features are tools designed to assist in candidate evaluation but are not infallible. AI algorithms may exhibit bias, make errors, or produce unexpected results. You acknowledge that:

  • AI-generated content may be inaccurate or inappropriate
  • Algorithmic bias may affect results
  • The system may fail to identify qualified candidates or may incorrectly rank candidates
  • You must exercise independent judgment in all hiring decisions

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGES ARISING FROM HIRING DECISIONS BASED ON OUR SERVICE
  • ANY DAMAGES FROM THIRD-PARTY DATA INACCURACIES OR SERVICE INTERRUPTIONS
  • ANY DAMAGES FROM AI ERRORS, BIAS, OR ALGORITHMIC FAILURES

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless Mara and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your hiring decisions
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any discrimination claims or employment-related disputes

8. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

9. Payment and Refunds

Payments for credits are non-refundable except as required by law. Credits do not expire but may be subject to account inactivity policies. You are responsible for all charges incurred under your account.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where BEON.tech is incorporated, without regard to conflict of law principles.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website. Your continued use of the Service constitutes acceptance of the modified Terms.
